第1条（適用）1. Scope

本規約は、Kerb の開発・提供者（以下「当方」）が提供するブラウザ拡張機能「Kerb」および本ウェブサイト（kerb.zone）（以下あわせて「本サービス」）の利用に関する条件を定めるものです。利用者は、本サービスを利用することにより本規約に同意したものとみなされます。 These Terms govern your use of the "Kerb" browser extension and this website (kerb.zone) (together, the "Service"), provided by the developer of Kerb ("we"). By using the Service you agree to these Terms.

第2条（本サービスの内容） 2. What the Service is

  1. 本サービスは、対応する AI チャットサイトへ送信されようとしているテキストをブラウザ内で検査し、機密情報・個人情報・認証情報に該当しうる記述を検出した場合に警告を表示する機能を提供します。
  2. The Service inspects, inside your browser, text you are about to send to supported AI chat sites, and displays a warning when it detects content that may constitute confidential information, personal data, or credentials.
  3. 本サービスは、現時点では送信のブロックを行いません。警告の後に送信するか否かは、常に利用者が決定します。
  4. The Service does not currently block sending. After a warning, whether to send remains entirely your decision.
  5. 本サービスは無償で提供され、アカウントの登録・認証を必要としません。
  6. The Service is provided free of charge and requires no account or sign-in.
  7. 検出された記録の保存先は、利用者ご自身が契約・用意したクラウドストレージ（Bring Your Own Storage。以下「BYOS」といいます。）です。当方はこれを保管しません。
  8. Records of detections are stored in cloud storage that you contract and provide yourself ("BYOS", Bring Your Own Storage). We do not retain them.

第3条（検出の限界・重要事項） 3. Limits of detection (important)

利用者は、本サービスの利用にあたり以下を理解し、承諾するものとします。 You acknowledge and accept the following when using the Service.

  1. 本サービスは既知のパターンとの照合により検出を行うものであり、あらゆる機密情報を検出できることを保証しません（検知漏れが生じます）。
  2. Detection is based on matching known patterns and does not guarantee that all sensitive information will be detected (misses occur).
  3. 本サービスは、機密情報に該当しない記述を検出する場合があります（誤検知が生じます）。
  4. The Service may also flag content that is not actually sensitive (false positives occur).
  5. 対応サイトの仕様変更により、警告が表示されない状態が生じる場合があります。
  6. Changes to supported sites may cause warnings to stop appearing.
  7. 本サービスは、利用者が遵守すべき法令・社内規程・契約上の義務を代替するものではありません。送信内容に関する最終的な判断と責任は、常に利用者に帰属します。
  8. The Service is not a substitute for laws, internal policies, or contractual obligations you are subject to. The final judgement and responsibility for what you send always rest with you.

第4条（データの責任分界） 4. Division of responsibility for data

  1. 入力本文を含む記録は、利用者が接続した BYOS にのみ保存され、利用者の管理下にあります。当該ストレージの容量管理・保全・アクセス権限の管理は利用者の責任です。
  2. Records, including input text, are stored only in the BYOS you connect and remain under your control. Managing that storage's capacity, retention, and access rights is your responsibility.
  3. 当方は、利用者の BYOS に保存されたデータにアクセスできず、その滅失・毀損・漏洩について責任を負いません。
  4. We cannot access data stored in your BYOS and are not responsible for its loss, corruption, or disclosure.
  5. 組織で本サービスを導入する場合、所属する利用者への周知および必要な同意の取得は、導入する組織の責務とします。当方は汎用的な通知文の表示を行うのみです。
  6. If an organization deploys the Service, informing its users and obtaining any necessary consent is that organization's responsibility. We only display generic notices.

第5条（禁止事項）5. Prohibited conduct

利用者は、本サービスの利用にあたり次の行為をしてはなりません。 You must not do any of the following when using the Service.

  1. 法令または公序良俗に違反する行為
  2. Violating any law or public order and morals
  3. 当方または第三者の知的財産権その他の権利を侵害する行為
  4. Infringing our or a third party's intellectual property or other rights
  5. 本サービスの改変、逆アセンブル、逆コンパイル、リバースエンジニアリング、または再配布
  6. Modifying, disassembling, decompiling, reverse engineering, or redistributing the Service
  7. 本サービスまたは関連設備に過度の負荷をかける行為、不正アクセス
  8. Placing an excessive load on the Service or its infrastructure, or gaining unauthorized access
  9. 本サービスの検出を回避する目的で、組織の規程に反して機密情報を送信する行為
  10. Circumventing detection in order to send confidential information in breach of your organization's policies

第6条（提供しないもの） 6. What we do not provide

当方は、本サービスに関して、次に掲げるものを含め、特定の利用者に固有の個別対応を要する事項を提供しません。あらかじめご了承ください。 We do not provide any of the following, nor anything else that would require accommodation specific to an individual user, in connection with the Service.

  1. 個別契約の締結、本規約の個別改変、オンプレミス提供、定例会議、専任サポート担当の割当て
  2. Individually negotiated contracts, amendments to these Terms, on-premises deployment, recurring meetings, or a dedicated support representative
  3. 稼働率・応答時間に関する保証（SLA）
  4. Any service level agreement covering uptime or response time
  5. 第三者認証（ISO 27001 / SOC 2 等）の提示、監査対応、業種固有の契約（HIPAA BAA 等）の締結
  6. Third-party certifications (ISO 27001 / SOC 2 etc.), audit support, or industry-specific agreements such as a HIPAA BAA
  7. 問い合わせへの返信の保証。お問い合わせは受け付けますが、返信・対応をお約束するものではありません。
  8. A guarantee of a reply. We accept enquiries but do not promise to respond or to act on them.
  9. 前各号のほか、特定の利用者のためにのみ行う調査・設定・開発・書面作成その他一切の個別対応
  10. Any other investigation, configuration, development, documentation, or other accommodation carried out for a particular user alone

なお、当方は利用者の業種によって本サービスの利用を制限しません。ただし、上記のとおり業種固有のコンプライアンス対応は提供しません。 We do not restrict use of the Service by industry. As stated above, however, we do not provide industry-specific compliance support.

第7条（サービスの変更・中断・終了） 7. Changes, suspension, and discontinuation

  1. 当方は、利用者への事前の通知なく、本サービスの内容を変更し、または提供を中断・終了することができます。
  2. We may change, suspend, or discontinue the Service at any time without prior notice.
  3. 当方は、誤検知その他の不具合が確認された検出ルールを、署名付きの設定配信により遠隔で無効化することがあります。
  4. We may remotely disable a detection rule found to misfire or malfunction, via the signed config delivery mechanism.

第8条（保証の否認および責任の制限） 8. Disclaimer and limitation of liability

  1. 本サービスは現状有姿（AS IS）で提供されます。当方は、本サービスの完全性、正確性、有用性、特定目的への適合性、および第3条に定める検出の性能について、明示・黙示を問わず一切の保証をしません。
  2. The Service is provided AS IS. We make no warranty of any kind, express or implied, as to its completeness, accuracy, usefulness, fitness for a particular purpose, or the detection performance described in Section 3.
  3. 当方は、本サービスの利用または利用不能により利用者に生じた損害（機密情報の漏洩、逸失利益、データの損失を含みます）について、当方の故意または重大な過失による場合を除き、責任を負いません。
  4. We are not liable for any damages arising from use of or inability to use the Service (including disclosure of confidential information, lost profits, or data loss), except in cases of our willful misconduct or gross negligence.

第9条（知的財産権） 9. Intellectual property

本サービスに関する知的財産権は当方または正当な権利者に帰属します。当方は利用者に対し、本規約に従って本サービスを利用する、非独占的かつ譲渡不能な権利のみを許諾します。 All intellectual property rights in the Service belong to us or the respective rights holders. We grant you only a non-exclusive, non-transferable right to use the Service in accordance with these Terms.

第10条（提供地域） 10. Geographic availability

本サービスは、日本の外国為替及び外国貿易法、米国 OFAC、EU その他適用ある制裁法令により取引が禁止されている国・地域および対象者による利用を認めません。 The Service may not be used in or by any country, region, or person subject to restrictions under Japan's Foreign Exchange and Foreign Trade Act, U.S. OFAC, EU, or other applicable sanctions regimes.

第11条（本規約の変更） 11. Changes to these Terms

当方は本規約を変更することがあります。変更後の規約は本ページに掲載した時点から効力を生じ、掲載後に本サービスを利用した場合、変更後の規約に同意したものとみなされます。 We may revise these Terms. A revision takes effect when posted on this page, and your continued use of the Service after posting constitutes acceptance of the revised Terms.

第12条（準拠法および管轄裁判所） 12. Governing law and jurisdiction

本規約は日本法に準拠し、これに従って解釈されます。本サービスに関して紛争が生じた場合、東京地方裁判所を第一審の専属的合意管轄裁判所とします。 These Terms are governed by and construed in accordance with the laws of Japan. Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
